This Privacy Policy is incorporated by reference into the Inkkas Terms of Service. By providing your personal information to Inkkas, you acknowledge that Inkkas may collect, use, and disclose your personal information as described in this Privacy Policy.

2. Information We Collect

The personal information we collect depends on how you interact with us and the requirements of applicable law. We collect information from current, prospective, and former customers, visitors, and guests through the following channels:

A. Information You Provide Directly to Us. When you use the Services, contact us, register for an account or our loyalty program (InkPass), place an order, enter a giveaway, or sign up for emails or text messages, we may collect your name, email address, mailing address, phone number, account credentials, order and payment information (such as billing address and payment confirmation), gift card, loyalty, referral, and review information, and other information you choose to provide.

B. Communications. We collect information when you request information, register to receive email or text messages, participate in promotions or loyalty programs, or otherwise communicate with us. Where permitted by law, we may record and store customer support calls and chat conversations.

C. Surveys and Reviews. We (or third parties acting on our behalf) may invite you to participate in research, surveys, or product testing, or to provide reviews and testimonials. Participation is voluntary. We may use this information to improve our products and Services and in any manner consistent with this Privacy Policy.

D. Giveaways and Contests. If you enter a giveaway or contest, we may collect your contact information and other information needed to administer it. To the extent permitted by law, we may also use this information for other promotional, marketing, and business purposes. See our Giveaway Rules.

E. Public Posts. Information you disclose in public areas of the Services (such as product reviews) or on third-party sites (such as social media) is public and is not subject to the protections of this Privacy Policy.

F. Information from Third Parties. We may receive information about you from other sources, including service providers that support our Services (such as Shopify), payment processors, data partners (such as Experian), and advertising and analytics partners, to supplement the information you provide. We treat this information in accordance with this Privacy Policy.

G. Automatically Collected Information. When you visit the Services, open or click our emails, or interact with our advertisements, we and our partners may automatically collect information such as your IP address, cookie and device identifiers, mobile advertising identifiers, browser type and language, approximate location derived from your IP address, operating system, internet service provider, referring and exit pages, the date and time of your visit, pages viewed, links clicked, items viewed or added to your cart, and other actions taken on the Services (“Usage Data”).

We may also enable Shopify to match your account with other Shopify services you choose to use (such as Shop), in which case Shopify will process your information as described in its own privacy policies.

B. Administrative Purposes. To measure interest in our products, develop new products and Services, ensure quality control, verify accounts, maintain and administer the Services, prevent prohibited or illegal activity, and enforce our Terms of Service.

C. Marketing and Advertising. To send you marketing communications by email, text message, or postal mail (where you have opted in or as otherwise permitted by law), including about offers, new products, and back-in-stock items, and to show you advertisements on our Services and on third-party websites and platforms. You can opt out at any time as described in Section 6.

D. Research and Analytics. To understand how people use the Services, improve our products and Services, and create anonymized or aggregated information. Anonymized or aggregated information is not personal information, and we may use and share it for any lawful purpose.

E. Security and Fraud Prevention. To detect, investigate, and prevent fraudulent, illegal, or malicious activity and to keep the Services secure. If you create an account, you are responsible for keeping your login credentials safe.

F. Legal and Other Purposes. To comply with legal obligations, respond to lawful requests, resolve disputes, establish or defend legal claims, and for any other purpose disclosed to you at the time we collect your information or with your consent.

If you are located in the European Economic Area or the United Kingdom, we process your personal information on the basis of performing our contract with you, our legitimate interests (such as selling our products, keeping our Services secure, and improving our Services), compliance with legal obligations, or your consent, as applicable.

We and third parties that provide content, advertising, or other functionality on our Services use cookies, pixels, web beacons, software development kits, local storage, and similar technologies (“Technologies”) to collect information automatically. For information about the cookies used to power our store with Shopify, see shopify.com/legal/cookies. Our uses of Technologies fall into these categories:

We also use Shopify’s advertising services, such as Shopify Audiences, to help personalize the advertising you see on third-party websites.

Most browsers accept cookies by default, but you can set your browser to remove or reject them. Blocking cookies may affect the functionality of the Services and may not completely prevent us from sharing information with advertising partners. See Section 6 for additional opt-out options.

7. Your Privacy Rights

Depending on where you live, including if you are a resident of California, Colorado, Connecticut, Maryland, Virginia, or another U.S. state with a consumer privacy law, or of the European Economic Area or United Kingdom, you may have some or all of the following rights. • Right to Delete: Request deletion of personal information we maintain about you, subject to certain exceptions.
  • Right to Correct: Request correction of inaccurate personal information.
  • Right to Portability: Receive a copy of your personal information in a portable format.

12. SMS Messaging Terms and Privacy

Inkkas operates an SMS marketing and transactional messaging program. This section explains our SMS-specific data practices in accordance with the TCPA and wireless carrier guidelines. By signing up for SMS marketing, you agree to our SMS Messaging Terms & Conditions.

A. How to Opt In. You may opt in by submitting your mobile number through a sign-up form on inkkas.com, entering your mobile number at checkout and consenting to SMS marketing, texting a designated keyword to our short code, or entering your number in a pop-up or promotional event opt-in form. By opting in, you expressly consent to receive recurring automated marketing text messages from Inkkas at the number provided. Consent is not a condition of any purchase.

B. What We Send. Promotional offers, exclusive discounts, and sale announcements; new product launches; personalized recommendations based on browsing or purchase history; abandoned cart reminders (see Section 4A); and order confirmations, shipping updates, and return notifications.

C. Message Frequency and Costs. Message frequency varies and may increase during promotional periods. You may receive up to 8 marketing messages per month. Message and data rates may apply.

D. How to Opt Out. Reply STOP to any marketing text message to unsubscribe. You will receive one confirmation message and no further marketing messages. You may also opt out by emailing ops@inkkas.com. Opting out of SMS marketing does not stop transactional messages related to active orders.

E. Help. Reply HELP to any message for assistance, or contact us at ops@inkkas.com or +1-347-471-1403.

F. SMS Data We Collect. Your mobile number; opt-in date, time, and method; message engagement data (such as delivery status and link clicks); opt-out date and method; and purchase or browsing activity following an SMS link click. We use this data to operate the SMS program, measure its effectiveness, and comply with legal and carrier requirements.

G. SMS Data Sharing. We will not share your SMS opt-in with any third party for purposes unrelated to providing you with the services of that campaign. We may share your personal data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including platform providers, phone companies, and other vendors who assist in delivering text messages. SMS opt-in data and consent status are never sold, rented, or shared for third-party marketing purposes. This applies independently of any other data-sharing provisions in this Privacy Policy.

H. SMS Data Retention. SMS opt-in and consent records are retained for the duration of your subscription and for a reasonable period afterward as required by law or carrier requirements. After you opt out, your number will be suppressed from future marketing messages.
